I guess it goes without saying that if they had executed this wretch for the cab driver's murder... then THIS innocent FAMILY would have been spared their own personal horror movie.

CHEROKEE COUNTY, S.C.-- The man who police accuse of abducting a family and holding them for 12 hours, has a prison record dating back to 1974 – including a conviction for first degree murder and time spent on death row.

Cherokee County, SC, Sheriff Bill Blanton said Jerry Douglas Case, 52, abducted a father, daughter, and two young children Friday evening in Gaston County, and made them drive around until they made a daring escape during a stop for gas near Gaffney.

Case was then critically injured in a shootout with police in the woods near the gas station.

According to a statement from Blanton, deputies responded to a call for help from the family around 5:30 Saturday morning.

The family told police they had escaped from their captor at a Kangaroo gas station at the Hwy. 18 exit off I-85 by driving away when the man went inside to get a gas pump turned on.

The sheriff did not identify the family.

Sheriff Blanton said deputies responding to the gas station chased the man into the woods, where they found him about 30 minutes later.

Blanton said the man, later identified as Case, fired at officers and they fired back, hitting him. One officer was shot in the leg, but it was a minor injury.

Case was airlifted to Spartanburg Regional Hospital, but his condition was not available Saturday night.

Store clerk Lora Greene said she heard about the shootout from another clerk who was on duty at the time Case came into the store. Police were still at the gas station when she came to work.

“When I got here they had the road blocked off on each side," said Greene. She found out Case and another woman, the daughter, had come into the store to buy gas and diapers. The woman got back in the car while Case reminded the store clerk to turn on the pump.

“That’s when the woman had the chance to drive off,” said Greene.

The NewsChannel 36 I-Team dug up Case’s prison record – and the court records that detail how he got there.

Case was convicted of first degree murder in 1986 for kidnapping a cab driver in Tennessee, forcing him to drive to Gaston County, then tying him up in a hotel room and stabbing him seven times. He was sentenced to death for the crime.

Case won a new trial in 1991 after the North Carolina Supreme Court found “reversible error” in his first trial.

Case pleaded guilty to second degree murder and second degree kidnapping, and was sentenced to life in prison plus 30 years.

Court records don’t detail why Case was released from prison after serving just 22 years of his sentence, but prison records show he was released in June of 2008.

North Carolina law no longer permits parole, unless a person is convicted before the 1994 Structured Sentencing Act took effect. Case was sentenced in his second trial in 1992, two years before structured sentencing.

Former death row inmate terrorizes family

BELMONT -- the family of four kidnapped in Gaston County on Friday by a former death row inmate was taken from the popular “hot hole” fishing spot in Belmont, authorities said.

The family, which has not been identified, managed to escape 12 hours later after the suspect, 52-year-old Jerry Douglas Case, stopped at a convenience store near Gaffney in Cherokee County, S.C.

Case was in serious condition Sunday at Spartanburg Regional Medical Center after a shootout with Cherokee County sheriff’s deputies Saturday. A deputy suffered a minor scratch on the leg during the exchange of gunfire.

Details around the case were still sketchy Sunday. Gaston and Cherokee authorities would not comment on Case’s motive or reveal the identity of the family. Details of the 12-hour ordeal also have not been released.

Case was sentenced to death in 1986 for kidnapping and killing a taxi driver. But his sentence was reduced in 1992, and he was paroled last year. Police say Case pulled over at the Kangaroo gas station and convenience store on Saturday for gasoline and baby diapers. The family was able to start the car and drive away.

Ten miles down the road, they stopped to call police and report the crime. Authorities said that Cherokee County deputies went to the gas station and chased Case into a swampy area, where they exchanged gunfire, hitting him several times. Case was airlifted to the medical center.

In Belmont, the shoreline and public pier were full of families fishing on Sunday evening. Many of them said they weren’t aware that the kidnapping happened there. “I really didn’t know,” said Sonny Stillwell, a Gastonia man out fishing with his wife and two teenage sons. “It could happen anywhere,” he said. “We’ll watch what we’re doing.”

Although the fishing area is about half a mile from South Point Road, on the edge of a wooded area, there are numerous houses along the shore and approaching along Canal Road. Carolyn Lindsay knew something was up when she saw police cars and news trucks rolling in front of her Canal Road home yesterday.

“It’s scary,” she said. “I don’t want to be sitting out here and feeling like I’m in danger,” she said, gesturing to the quiet woods behind her. She said she won’t let her daughter walk around near dark anymore. “We’ll keep our guard up and keep the doors locked,” she added.

The hot hole is a popular fishing spot on the South Fork River in Gaston County. It’s named for the warmer water created by Duke Energy’s nearby Allen Steam Station power plant. Ely Portillo contributed.
