Supreme Court orders new trial for death row inmate James Cooke

The Delaware Supreme Court has ruled that convicted murderer James Cooke should receive a new trial in the 2005 rape and slaying of University of Delaware student Lindsay Bonistall.
The divided high court ruled that public defenders erred in entering a guilty but mentally ill plea on Cooke's behalf, even though he did want the plea entered.

April 27, 2005 James Cooke Jr. breaks into Cheryl Harmon's apartment at 11 Thorn Lane in Newark, Del., across an alley from his home, and steals two rings with her name on them.
April 30
• 1 a.m.: Cooke confronts Amalia Cuadra in her West Park Place house and threatens to kill her if she doesn't turn over money and credit cards. He demands that she take her clothes off but flees when she yells, "Christina, Christina," her roommate's name.
• 4:19 a.m.: Cooke tries to use one of Cuadra's credit cards at a nearby automated teller machine.
May 1
• 1:15 a.m.: Lindsey Bonistall returns to her apartment at 81 Thorn Lane.
• 2:45 a.m.: Firefighters respond to reports of smoke at Bonistall's apartment and extinguish a fire. They leave to battle another fire a few blocks away.
• 12:30 p.m.: Fire officials and a Newark detective return to Bonistall's apartment and find her body under charred debris in the bathtub. She had been gagged, raped and strangled.
May 2, 2005 Cooke disguises his voice on a 911 call to Newark police in which he claims the killing and the Harmon burglary were the work of a white supremacist drug gang. He uses Harmon's name and the name of Cuadra's roommate, which had not been made public, helping police link the three crimes.
Late May Cooke's bosses at a shoe store tell police they recognize Cooke in a poster showing a surveillance photo from the ATM.
June 6 Cooke is arrested in Wilmington, Del., on charges in the second break-in. He is charged that week in Bonistall's killing when results of DNA testing, with odds of 1 in 676 quintillion that it was someone else, link him to the rape.
Jan. 23, 2007 Cooke's trial begins.
March 8 Cooke is convicted of first-degree murder after the jury rejects his lawyers' contention that he was guilty but mentally ill.
March 21 The jury recommends the death penalty for Cooke.
Yesterday Superior Court Justice Jerome Herlihy finds that the aggravating factors outweigh the mitigation and sentences Cooke to death by lethal injection.

Lindsey Marie Bonistall
May 5, 2005--Lindsey Marie Bonistall, 20, a UD sophomore from White Plains, N.Y., was murdered May 1.
At UD, Ms. Bonistall was an English/journalism major, and she had published several articles in The Review, the student newspaper.
UD President David P. Roselle said, “The entire University of Delaware community is shocked and saddened by this terrible tragedy. We extend our deepest sympathies to the members of the Bonistall Family as well as to her family of friends here on the University campus.”
According to an obituary released by the family, Ms. Bonistall attended St. Anthony Elementary School in West Harrison and graduated as a Presidential Award recipient from Good Counsel Academy.
A talented gymnast, she was a member of the nationally ranked Good Council Cheerleading and Empire State All Star Cheerleading Teams. She was awarded the Westchester County Cheerleadership Scholarship and coached cheerleading on a local and national level for the Universal Cheerleading Association. Ms. Bonistall also was the captain of her high school soccer and track team, an active volunteer and a leader on the Mayor’s Youth Council in White Plains.
The obituary reads, in part, “With her bright smile and mischievous manner, it was clear early on she would embrace life with incredible humor and affection.... It is said we measure the significance of our lives by valuing the lives of others. Lindsey exemplified this by consistently seeing the best in those she touched and living her life honoring the family mantra of ‘love one another.’ Life without her warm smile, comical ways and heartfelt hugs will be a challenge. Yet we know in our hearts she will be with us through our own journeys every step of the way.”
She is survived by her parents, Mark and Kathleen Bonistall; an older sister, Kristen; her grandmothers and many aunts, uncles and cousins.
Visitations will be held from 5-9 p.m., Thursday, May 5, and from 2-4 and 7-9 p.m., Friday, May 6, at McMahon, Lyon & Hartnett Funderal Home, 491 Mamaroneck Ave., White Plains, N.Y. The Mass of Christian Burial will be at 10 a.m., Saturday, May 7, at St. Anthony of Padua Catholic Church, 85 Harrison St., Harrison, N.Y.

Cops working Lindsey Bonistall's murder case wanted nothing more than to catch her killer and put him behind bars. After all, his crime was vicious -- they say he raped and strangled the 20-year-old, then set her apartment on fire to destroy the evidence. Luckily, the killer's firey plan failed -- investigators were left with enough evidence to carry out a solid investigation. At Lindsay's home, the killer left cryptic writing on the wall. However, cops have yet to disclose the message.
On June 7, 2005, cops hauled in James E. Cooke on home invasion charges. The incident occured on April 30, 2005 and crime cops believed the invasion was linked to Lindsey's murder. Sure enough, one week later, cops say they had "physical evidence" proving he was also responsible for Lindsey's grisly murder.
"Physical Evidence" Links Cooke To Murder
Ever since Lindsey was found murdered in her apartment off-campus at the University of Delaware on May 1, 2005, cops were investigating a possible connection between her murder and a home invasion that had occured the night before the murder. The victim of the home invasion attack was lucky enough to survive -- only her ATM card was stolen. Soon after the attack, ATM surveillance cameras captured video of the attacker trying to withdraw money using the card. Cops posted flyers around town hoping someone would recognize his face and turn him in. They hoped the man in the ATM surveillance could answer for the home invasion as well as provide investigators with answers in Lindsey's case.
On May 31, 2005, Newark, Del. cops received a tip from one of Cooke's aquaintances, who told them they'd seen his picture on a wanted poster. Cops followed up on the tip and spoke with Cooke's girlfriend. Cops say she confirmed his involvment in the April 30 home invasion when she told them she had seen Cooke in posession of some stolen items from the attack.
